Met With an Accident Yesterday

Hi,

Sad to here about accident.

This might be out of context in some sense.
My vehicle is 1 year old. I recently renewed my insurance.
It was comprehensive one. What bothers me is the "Third Party" Insurance part.

Please pardon me if I am not making any sense at all, but in ideal situation shouldn't the third party component come into picture in a situation where other person is injured?

I understand there should be some protocol or procedure that might be needed to follow.

Also under what circumstances third party component is usually exercised?

On a lighter note, at least in Pune, whatever happens, mistake is always of a person driving four wheeler. Let the two wheeler guy be one doing rash drive, he will always attract sympathy.

So Today I got a Call from police station that the other guy who was injured is filing a complaint against me and they summoned me.
I went to the police station along with some of my friends and they told me that do some compromise with him or we will file a case and you can fight in court.
the other guy demanded 3.5K and expenses he might have in near future. The police thrashed him and told him that he cannot cry for compensation and this guy (me) cannot pay you for lifetime. We told him that we will pay 1500 INR and nothing more than that and no future expenses. This Guy became adamant and told the policeman that they will file the police complaint and fight it in court. The policeman told him that they wont entertain him and he can go to a different police station to file the complaint. Later his friend who was driving the Bike told him to give it up and take the money (btw his friend that day was riding a bike without insurance!!!) and he was afraid of himself if the case goes to court.
Later we settled on a amount of 2k and he gave in writing on the police book that he got the money and wont demand any more.

Thanks Appus but my only concern is that he has signed the document that he wont demand any more money but can he still file a case in another police station?

Hope you have a copy or the original document with you and it is endorsed by the police.

He has to file the case in the PS in whose jurisdiction the accident happened. Any other PS should not entertain him. Police even does not take murder cases , if it falls to other jurisdiction.

I don't have the copy of the document [confused] but it was signed by me and him. The had written that on the book which they maintain in the police station.

Forget about it nothing will happen again, if whenever if you get any call from that guy just tell him that his bike doesn't have any valid insurance and he will inform the same police station people where he will be behind the bars next. Do not worry at all, be brave man

thanks for all the support. I have Decided NOT to drive anymore. Driving Should be a pleasant Experience but here in India it is taxing both physically and mentally. I will go ahead and sell my car and if I have to go anywhere I would use the Taxi. I will Still be an active member of this forum.

That is really sad. If it is not much financial burden, I suggest you to retain the car for weekend/casual drives. Selling car, you will lose much money in depreciation.

If an FIR is taken then ask the police guy who talked to you to add in the FIR that the bike doesn't had a valid insurance at the time of the accident.
A case can always be filed against you via court even if the compromise was done in the police station and even if there is an agreement too.
A good advocate may claim that the compromise is done on your influence with the police station.
so it is safe if it is noted in the FIR that the bike does not had a valid insurance and so for this reason that guy asked for a compromise.

If it was your fault then you should fulfill all that he desires but take care he doesn't take much advantage.Spend only that is apt.

[surprise] I am surprised/shocked by this step. I mean for me driving/riding is my passion and i feel its the same for you. I just cannot imagine my life without my car/bike . Plus on the other hand after selling your car you wont have any other option but to travel using Public Transport i.e. Taxi ,Bus , Rikshaw that will give you more headache every day than what u've faced in this case .

If the other guy files an FIR then you always have option to Fir an Cross FIR against bike rider and place your side of story ibefore Hon' Court. Dont worry Be happy , take a vacation and go for long drive [:D].

No sir, you should not do that at all. In hindi one saying is there "Marne ke liye Jenna chod dun" (Translate to English "Shall I stop living since I know some day I will die).

For a useless moron, you are taking a drastic step. I am not finding the logic also. Now something bad will happen while on taxi, you will say I will not anymore use taxi.I will go by walk, where I need to go. Then something bad will happen on road, you will say now, I will not use road any more.

Try to live the life, do not get away from it. Bad time happen to everybody (your case is not that bad, it is a part of life). Try to get over it.

Keep driving and do not sell the car.
