hi all
I have a doubt regarding my license.

I am licensed to drive an lmv vehicle, does this include a taxi registered car which is being used privately?
Or should i need a badge to drive one even if its not used for carrying public?
is it an offense? [confused]

Hello everyone,

Me and few of my friends are in the process of finalizing a business venture, for which i need few inputs form our members.

1) Is it legal to allow another person to drive one's vehicle?
2) If yes, do we need to carry any approval letter or a NOC?
3) I guess its illegal to give a personal vehicle to hire, like if it involves a financial transaction. I am talking about giving a personal vehicle to another person without a financial transaction, it that legal?

Good news: New draft bill to replace old Motor Vehicles Act 1988
Driving an uninsured car or motorcycle may soon cost you dear, if proposals given in the new Road Transport & Safety Bill are passed without changes by the Parliament. On the other hand, it sure will turn into a boom time for general insurance companies. For a motorcyclist caught riding without an insurance policy, the penalty will be Rs.10,000. Owners of light motor vehicles and autorickshaws will have to cough up Rs.25,000, as per the new rules. Similarly, any car or a truck driver caught driving without the policy will have to pay as high as Rs.75,000. Compare this to a meager fine of Rs.1,000 for all vehicles currently in place under the law.

New Bill to replace Motors Vehicles Act

The draft version of the Bill was put on the ministry's website on September 13 to accumulate feedback from the general public. Reportedly, it has attracted widespread attention due to its proposals for stringent penalties with respect to traffic offences such as drunken driving and accidents in which children are killed.

The visible benefit of this new draft bill, if implemented without changes is that the fines for driving uninsured vehicles will be made compulsory and will drive up insurance penetration manifold . Vijay Kumar, Head of Motor Insurance at Bajaj Allianz General Insurance said, "This (the enhanced penalties) will increase penetration of motor insurance." Incidentally, the new bill will replace the ageing Motor Vehicles Act, 1988.

Interestingly, a study by New India Assurance Ltd. has shown that nearly 70 per cent of motorcycles and scooters on road are not insured. Similarly, about a third of the cars and trucks are uninsured as well. Insurance company officials say that penalties should go beyond fines and lead to loss of license for repeated violations. Echoing these sentiments, Sanjay Datta, Head of Motor Insurance at ICICI Lombard says, "More than the extent of fine, it is the ability not to drive that would be important for insurance companies. If the rules say that a three time motorcycle offender will lose his license, it will bring discipline."

The Insurance Regulatory & Development Authority is easing its rules to promote increase insurance compliance. It has allowed longer tenure policies, which include a three-year policy for two-wheelers, as well as third-party insurance. On the same lines, long term products for car insurance are also in the works. Insurance companies have suggested to the Government to limit third party liability at Rs.10 lakh. So far, liability for motor vehicles has been unlimited, though it is capped at Rs.5 lakh for aircraft and Rs.2 lakh for railways.

Apart from the above, the industry also wants the claim to be allowed under two jurisdictions-first, where the accident has happened and the second, where the vehicle is registered. In addition, the claim has to be filed within three years of the mishap occurrence. The Bill has also proposed setting up a motor accident fund to help grievously injured people and to compensate legal representatives of a victim.

I am seeing messages and news articles all over that new traffic fines have been enforced. Can some one point to any official article/page for same ?

Now a days i have seen many cops having digi cams. They simply click photos of those who break the traffic rules like stop line violation, riding without helmets.

There are other cops present with the challan machines but still they click pics.

Sending challans direct at home :D

This is also some important rule

Section 112: it is denoted to The highest speed at which each class or type of motor vehicle can be driven.
Section 113: According to this rule the driver should not drive a vehicle exceeding the weight permitted to carry.
Section 129: According to this rule any person driving a motor cycle shall wear helmet.

New Motor Vehicles Law Passed?

Hi,

there is a message doing the rounds on WhatsApp saying that the 2014 Motor vehicles act has been passed by Parliament and is in force now. Not sure I saw this confirmation/ news. Can someone confirm.[surprise]

Also, one of the clauses I am told is that the original papers must be carried in the car. Is this the case? I normally carry the original RC book and my license in my wallet but all other papers are photocopies[roll]

Not sure about the new MVA, but...

Section 130: The driver of a motor vehicle in any public place shall, on demand by any Police Officer in uniform, produce his Driving Licence, Registration Certificate, Insurance Certificate, Fitness Certificate and the Permit can be demanded in this manner by Officers of Motor Vehicles Department only.
And a word of advise, don't keep original papers in the car itself [:)]

Ok, what is a fitness certificate?. Never heard of that
Original RC is valid for 15 years (for private vehicles) and after that one should produce the vehicle to RTO in person and they will inspect the vehicle for Road worthiness and provide a Fitness certificate.

That's actually incorrect Shri, Here in Delhi-NCR, Traffic Police can make out the difference between a Xerox and original. Its always safe to keep the originals ready dear. A duplicate license can lead you into big mess. Duplicate R C on the other hand if found can lead to penalty on many occasions.

this was the case from the beginning that you have to produce the original vehicle documents whenever asked. you keep that in you wallet or in the car that's immaterial as long as you produce it when asked.
regarding Fitness Certificate or FC
For a private vehicle FC is to done once it crosses 15 years from the date of original registration and not from the date of manufacture of the car. for a private car which is crossed 15 years you should carry FC. GT ( Green Tax Receipt). Insurance. EC ( Emission Certificate) and RC as well as your Driving license.
If you have a Taxi FC is done every year. ( this was just for info).documents to carry would be RC,FC,Insurance,EC, Permit.driver badge, drivers license. TAX Card

Ok, my first car was 6 years old and I bought the Swift in October. I doubt that most newage Marutis will last 15 years.
I have a wad of photocopies in the glove box that include copies of all the invoices as proof of purchase, insurance etc. But I keep my originals at home for safe keeping. I carry the original license obviously and the original RC card by force of habit. Sometimes I worry that if my wallet is stolen, the RC will go along with it. Hence the question
