Volkswagen Jetta Tyre Queries

Hi Guys,
I had this doubt from long time. In my jetta manual, it is written as
2 people = 31psi
5 people = 38 psi.

But why is there such a huge difference between the tyre pressures?

I maintain around 36 psi on each wheels

Won't the tyre become overinflated in such case if only a single person sits in the car?
EDIT : I think so 34 would be the best and the most suitable in that case.

The car is loaded with 2-3 Persons and some luggage hence slightly higher pressure.

But according to highway rules in europe, I found that the minimum and maximum pressures are 35 & 42 respectively for cars & mini vans. Does this apply for India?

One more OT doubt - Is it better to fill our tyres with nitrogen or compressed air?

I would assume that the manual would be the correct place to look for this information.

My jetta manual didnot specify to go for nitrogen or normal compressed air.
